Divorce and Separation
Navigating a separation is emotionally draining. Our solicitors guide you through every step of the divorce process in NSW — from applying for divorce orders to managing the legal formalities that follow — so you can focus on rebuilding your life. We handle both straightforward and contested matters efficiently and with care.
Property Settlement
Dividing assets after separation is rarely simple. In Australia, there is no automatic 50/50 split. Our family lawyers advise on the full four-step process: identifying the asset pool, assessing financial and non-financial contributions, considering future needs, and ensuring the final outcome is just and equitable for you. We advise on superannuation splitting, business valuations, and the merits of consent orders versus a Binding Financial Agreement (BFA).

Spousal Maintenance and Child Support
Financial support following separation — whether for children or a former spouse — can be a source of significant conflict. Our team advises on Child Support Agency assessments, private agreements, and spousal maintenance applications, helping you achieve a fair outcome without unnecessary disputes.
Domestic Violence and ADVO Applications
If you or your children are at risk, we act quickly. Our family lawyers assist with Apprehended Domestic Violence Order (ADVO) applications in the NSW Local Court and advise on how family violence affects your broader family law proceedings. Your safety is our first priority.
De Facto Relationship Disputes
De facto couples in NSW have the same rights and obligations as married couples under the Family Law Act 1975. If your de facto relationship has broken down, we advise on property settlements, parenting arrangements, and maintenance in exactly the same way as for married couples — with the same level of care and expertise.
Binding Financial Agreements
A Binding Financial Agreement (BFA) — sometimes called a ‘pre-nup’ — can protect your assets both before and during a relationship, or formalise an agreement after separation. Our solicitors draft and review BFAs to ensure they are legally sound and genuinely in your best interests.

Frequently Asked Questions
Find clear answers to common family law questions in Sydney, including divorce, child custody, property settlement, and legal rights.
How much does a family lawyer cost in Sydney?
Costs vary depending on the complexity of your matter and whether it is resolved by agreement or proceeds to court. Simple uncontested divorces can cost a few thousand dollars. Complex property or parenting disputes that go to final hearing can be significantly more. At Kazi & Associates, we provide transparent, upfront pricing and always explore the most cost-effective path for your situation. Contact us for a free consultation and an honest cost estimate.
How long will my family law matter take?
An uncontested divorce application takes a minimum of one month by law. Negotiated property and parenting settlements can be reached in weeks to several months. Contested matters that proceed to a final hearing can take 18 months or more in the Federal Circuit and Family Court of Australia. We always aim to resolve matters as efficiently as possible and will give you a realistic timeframe estimate during your initial consultation.
Do I have to go to court?
Not necessarily — and in most cases, we actively try to avoid it. The majority of family law matters are resolved through negotiation, mediation, or a collaborative process. Court proceedings are typically a last resort when parties cannot reach agreement or when urgent orders are required. Our goal is always to find the fastest, most cost-effective resolution for your family.
What happens to our assets when we separate?
In Australia, there is no automatic 50/50 division of property. The court considers a four-step process: identifying the total asset pool (including superannuation), assessing both parties’ financial and non-financial contributions, considering future needs, and determining whether the proposed split is just and equitable. The outcome depends on your specific circumstances. Our family lawyers will assess your situation and give you a realistic picture of what a fair settlement looks like for you.
How are custody and parenting arrangements decided?
The law in Australia focuses on the best interests of the child as the primary consideration. This includes the child’s right to a meaningful relationship with both parents (unless safety concerns arise) and protection from harm. Parents are strongly encouraged to reach an agreement through a parenting plan or consent orders rather than going to court. If court proceedings are necessary, the judge makes orders based on what is best for the child — not the preferences of either parent.
Can I get legal help if I don't speak English fluently?
Absolutely. At Kazi & Associates, we provide family law advice and representation in English, Bengali, Hindi, Japanese, and Urdu. Legal matters are complex enough without a language barrier — our multilingual team ensures you fully understand your rights, your options, and the implications of every decision. Contact us to arrange a consultation in your preferred language.
What is a Binding Financial Agreement (BFA)?
A Binding Financial Agreement (BFA) is a legally enforceable agreement between two people that sets out how property and financial matters will be dealt with during or after a relationship. Often called a ‘pre-nup’, BFAs can be made before, during, or after a relationship. They can protect assets you bring into a relationship or formalise an agreement reached after separation. Both parties must have independent legal advice for a BFA to be valid. Our family lawyers draft and review BFAs to ensure they are watertight and genuinely protect your interests.
What should I do if I am experiencing domestic violence?
Your safety is the first priority. If you are in immediate danger, call 000. If you need legal protection, our family lawyers can assist you in applying for an Apprehended Domestic Violence Order (ADVO) in the NSW Local Court. We can also advise on how family violence affects your family law proceedings, including property settlement and parenting orders. We handle these matters with the urgency and sensitivity they demand.
Is there a time limit for property settlement after separation?
Yes. In Australia, married couples must apply to the court for property settlement within 12 months of their divorce being finalised. De facto couples have two years from the date of separation. If you miss these deadlines, you will need to seek leave from the court to proceed — which is not guaranteed. This is one of the reasons we strongly encourage people to seek legal advice as early as possible after separation.
